Monona, Wisconsin Building Codes

Overview

The city of Monona, Wi. adopted the Uniform Dwelling Code, SPS chs. 320–325. The city also expressly adopted the Wisconsin Commercial Building Code SPS chs. 360-366. Monona, Wi. Mun. Code §§ 15-1-40, 15-1-41 (codes adopted) (accessed 4/15/2015).

Sec. 15-1-42 – Reference Standards.

Without expressely adopting the following model codes, this section recognizes the BOCA Basic Building Code, and the Wisconsin Uniform Building Code as “prima facie evidence of safe construction”. Monona, Wi. Mun. Code § 15-1-42 (reference standards) (accessed 4/9/2015). Since the Wisconsin Uniform Building Code updates with the State building codes there would be no conflict with this standard. However, the Boca Basic Building Code is out of date and would likely not be consistent with some of the ICC codes.

Sec. 15-1-3 Scope and Applicability.

(a) The sections contained in this Chapter shall be binding alike on every owner of a building, every person in charge of or responsible for or who caused the construction, repair, or alteration of any building or structure, professional engineer, or other person who shall prepare plans for the construction, alteration or addition to any building structure in the City.

 

This provision seems to apply this code toward any building regardless of construction date including pre-1980 dwellings.

 

Existing Buildings

Existing buildings, meaning buildings that were built in accordance to code at the time of construction, typically merit extra consideration in a current updated code.

Sec. 15-1-26 Conformance for Additions, Alterations and Change of Use.

(a) Building to Conform to Code After Major Alteration or Repair. The following specified requirements in this section shall apply to existing buildings which do not conform to the requirements of this Chapter for new buildings. If alterations or repairs are made to any existing building, where deemed practical by the Building Inspector, the entire building shall be made to conform to the requirements given herein for new buildings.

(c) Alteration and Repairs. Every alteration or repair to any structural part or portion of any existing building shall, when deemed necessary in the opinion of the Building Inspector, be made to conform to the requirements of this Chapter.

Commercial Building Code

Monona adopted the 2009 IBC, statewide. Note that adoptions usually come with amendments. So, it is important to review those amendments in addition to the unamended model code.

The city of Monona, Wi. adopted the Wisconsin Commercial Building Code SPS chs. 360-366. Monona, Wi. Mun. Code § 15-1-41 (codes adopted) (accessed 4/15/2015). The statewide code includes the 2009 ICC codes (IBC, IEBC, IFGC, IECC, and IMC). The city provides certain grandfathered ordinances (variances to the CBC). An ordinance that is grandfathered has passed the requirements laid out by the Legislature in Wisconsin Statute §101.02(7r)(b). The 2009 IEBC is made part of the Commercial Building Code, subject to the modifications specified in the Wis. Adm. Code § SPS 366.
