Elkhorn, Wisconsin Building Codes

Overview

For residential properties, Elkhardt adopted both the Wisconsin state building code with amendments, including an amendment that makes the code applicable to all work except minor repairs, and the Southeastern Wisconsin Building Inspectors Association's Wisconsin Uniform Building Code.  See Elkhorn Code of Ordinances, Ch. 14.

For commercial properties, Elkhorn adopts the Wisconsin Commercial Building Codes.  See Elkhorn Code of Ordinances, Ch. 14.

Wisconsin adopts its very own residential building code by regulation.  See Wis. Adm. Code § SPS 320 (accessed 11/11/2013).  In other words, it has not adopted the IRC.  The Wisconsin code is a statewide code that applies to new construction, but allows local jurisdictions to adopt the code, extend it to existing buildings, and add requirements.  So, local laws should be reviewed in most instances.

Wisconsin adopted the 2009 IBC with amendments. See Wis. Adm. Code § SPS 361.05 (accessed 11/15/2013).  Wisconsin amends its commercial code by Administrative Code.  See Wis. Adm. Code § SPS 361, Administration and Enforcement;  Wis. Adm. Code § SPS 362, Building and Structures.

Authority for the adoptions is found in statute. See Wis. Stat. Ch. 101.

Considering the fact that Wisconsin has state adopted laws on building codes, the title chosen for a model code by the Southeastern Wisconsin Building Inspectors Association creates opportunity for confusion with state administrative codes.

Existing buildings, meaning buildings that were built in accordance to code at the time of construction, typically merit extra consideration in a current updated code.

Elkhardt adopted amendments to the state residential code which make it applicable to existing homes for everything except minor repairs.  It does so indirectly by refering to reuirements for permitting and permission to work.  See Elkhorn Code of Ordinances, Ch. 14, § 14.02.
