The course, “Waiver and Estoppel,” is designed to familiarize adjusters and litigators with important aspects of the legal principles of waiver and estoppel as applied to property and casualty insurance coverage. The module is presented by attorney William A. Schneider of Morrison Mahoney.

In this two hour course, the instructor explains waiver and estoppel and discusses how courts apply these judicial doctrines to prevent insurers from applying terms and conditions of an insurance policy and other rights normally afforded them under the law. Mr. Schneider provides tips on avoiding waiving and estoppel through the use of reservation of rights letters and non-waiver agreements. He concludes with hypothetical examples.

After completing the course, the attendee will be able to list the elements of waiver and estoppel; explain the key differences between proving waiver and estoppel; discuss why in some situations waiver may be appropriate in order to retain control of a defense; recognize when waiver or estoppel entitles an insured to independent counsel; describe the “no coverage by waiver or estoppel doctrine;” and enumerate good practices that can be used to effectively reserve rights.

The course is designed for practitioners and insurance professionals working in the area of insurance coverage disputes and litigation. Professionals in both the liability and property arena will find this module beneficial.
