The Condominium Liability Coverage For Unit Owners and Associations course is designed to familiarize adjusters and litigators with important aspects of condominium law relating to liability insurance for condominium unit owners and associations. The module was written by and is presented by liability coverage attorneys Eric Friedemann, Nancy Aufrecht, Frank Gagliardi and Joe Martan.

The module begins by discussing the nature of- and laws allowing the creation of- condominiums, condominium associations and the history of condominiums. Issues regarding homeowners liability coverage for individual units are then addressed. Finally, issues regarding commercial general liability (CGL) coverage for condominium associations are explored.

After completing the course, the attendee will be able to better understand the nature and origin of condominiums and basic condominium law, liability issues facing homeowners insurers writing coverage for condominium unit owners and liability issues that face commercial general liability carriers writing coverage for condominium associations. Having taken the course, the attendee should be able to:

  • explain the history and nature of condominiums- individual units, condominium associations and the laws that allow their creation and maintenance;
  • make decisions regarding the availability of loss assessment coverage in homeowners policies covering condominium units;
  • handle or litigate coverage claims involving “business” exclusions under homeowners policies covering condominium units;
  • appraise whether a particular part of real property constitutes an “insured location” so as to trigger applicability of liability coverage under homeowners policies covering condominium units;
  • assess premises risks common to losses involving homeowners policies covering condominium units;
  • discuss who is an insured under standard CGL policies covering condominium associations;
  • describe the applicability of CGL and business protector (BP) liability coverage under standard CGL and BP policies covering condominium associations;
  • recite and appreciate issues relating to third-party liability claims against condominium associations;
  • deal with unit owner and general subrogation claims brought against condominium associations.

The course is designed for practitioners and insurance professionals working in the area of third-party liability insurance coverage and litigation.
