The course “Commercial Property: Covered Property” is designed to enhance the knowledge, understanding, and/or competence of the student regarding insurance principles and coverages and relevant case law in commercial property insurance policies.
This course explores the fundamentals of coverage analysis for property losses and damage sustained under the 2002 edition of the ISO CP 00 10 policy form. This course begins with a broad discussion of the three areas of Covered Property under the policy – Building, Business Personal Property, and Personal Property Of Others. Then, each area is discussed with a detailed analysis of the types of property listed as included under each category of Covered Property.
This course has two goals. The first goal is to enable the student to identify the category into which a particular item of lost or damaged property falls. This involves an analysis of the three categories of Covered Property using examples to illustrate how courts have discussed what constitutes Covered Property. Since each category of Covered Property also includes a subset of covered property, the definitions of each of those will be highlighted.
The second of the course’s two goals is to enable the student to identify what property is not covered under the policy. This involves a discussion of the relevant areas of the Property Not Covered section in the policy. The student will also be introduced to the Coverage Extensions in the policy, which may extend existing coverage or give back limited coverage for certain items listed under Property Not Covered. This study will include analyses of hypothetical coverage scenarios and relevant case law.
After completing the course, the student will understand what facts are important to courts in determining coverage under an ISO Commercial Property policy, will be able to distinguish between covered property and property that is not covered under the policy, and will understand the analysis necessary to determine whether an item falls under any category of Covered Property.
