Overview
The city of Fitchburg, Wi. adopted the Uniform Dwelling Code, SPS chs. 320–325, and also expressly adopted the Wisconsin Commercial Building Code. Fitchburg, Wi. Mun. Code § 35-77 (accessed 4/9/2015).
The city also adopted the 1987 NFPA 1 Fire Protection Code. This section also references the statewide Fire Code, which adopted the 2012 NFPA 1. Fitchburg, Wi. Mun. Code § 44-179 (NFPA adopted) (accessed 4/9/2015).
The Fitchburg Building Code applies to all residential and commercial buildings regardless of time of construction, with some exceptions, as stated here:
“The provisions of this article shall apply to all new construction, all additions and alterations to existing buildings, all remodeling, repairs and maintenance of existing buildings, building use changes, buildings being moved from one location to another and to demolition of buildings.” Fitchburg, Wi. Division 10. – Existing Buildings. The provisions outlined in division 10 apply to both residential and commercial buildings.
“The requirements specified in this division shall apply to all existing buildings which do not conform to the requirements of this article for new buildings. If alterations or repairs are made to any existing building, where deemed practicable by the building inspector, the entire building shall be made to conform to the requirements specified herein for new buildings.” Fitchburg, Wi. The city of Fitchburg, Wi. adopted the Wisconsin Commercial Building Code. Fitchburg, Wi. Mun. Code § 35-77 (accessed 4/9/2015). The statewide code includes the 2009 ICC codes (IBC, IEBC, IFGC, IECC, and IMC).
The city provides certain grandfathered ordinances (variances to the CBC). An ordinance that is grandfathered has passed the requirements laid out by the Legislature in Wisconsin Statute §101.02(7r)(b). The grandfathered ordinances are available at the DSPS website (click here) (PDF version here).
