Overview

Stevens Point adopted the Wisconsin state residential and commercial codes.  Stevens Point Municipal Code, Ch.30. Building Code, § 30.1 (4) (accessed 7/10/2014).  The Wisconsin state residential code is a statewide code that applies to new construction, additions and alterations for buildings constructed after 1980.  Wis. Adm. Code § SPS 320.04 Applications (accessed 7/9/2014).  Stevens Point expands the application of the state building code to apply to not only new buildings, but also to alterations, additions and repairs. Stevens Point Municipal Code, Ch.30. Wisconsin adopted the 2009 IBC.  It applies to "code applies to all public buildings and places of employment" with certain exception.  See Wis. Admin. Code § 361.02. The Code defines "public buildings" and "places of employment." Id.

The highest authority is reserved by the state. See Wis. Admin. Code § 361.03. However, local jurisdictions may adopt stricter standard that are not in conflict. Id.  Furthermore, local jurisdiction, including counties, may take on inspection and review responsibilities.  See Wis. Admin. Code § 361.60.

 

Wisconsin adopted the 2009 IEBC, subject to the modifications specified in chapter SPS 366.

Existing Buildings

Existing buildings, meaning buildings that were built in accordance to code at the time of construction, typically merit extra consideration in a current updated code.

Stevens Point expands the application of the state building code to apply to not only new buildings, but also to alterations, additions and repairs.

(5) Application of Code. All buildings and structures hereafter erected, altered, repaired, moved or demolished that are used or designed to be used for the purpose herein defined shall comply in full with the requirements of this code and Ch. DOC 20-25 as adopted and all amendments thereto.

(b) Alterations, Additions, and Repairs. The following provisions shall apply to buildings altered or repaired or additions thereto.

1. Additions and alterations, regardless of cost, made to an existing building shall comply with the requirements of this code for new buildings.
2. Roof Coverings – Whenever more than twenty-five (25) percent of the roof covering of a building is replaced in any twelve month period, all roof covering shall be in conformity with applicable sections of this code.
3. Repairs – Repairs for purposes of maintenance, or replacements in any existing building or structure which do not involve the structural portions of the building or structures, or which do not effect room arrangement, light and ventilation, access to or efficiency of any exit stairways or exits, fire protection, or exterior aesthetic appearance and which do not increase a given occupancy use, shall be deemed minor repairs
4. Alterations When Not Permitted – When any existing building or structure, which for any reason whatsoever does not conform to the regulations of this Code, has deteriorated from any cause whatsoever to an extent greater than fifty (50) percent of the equalized value of the building or structure, no alterations or moving of such building or structure shall be permitted. Any such building or structure shall be considered a menace to public safety and welfare and shall be ordered vacated and thereafter demolished and debris removed from the premises.
