Overview
West Bend adopted the state residential code with amendments. "Wisconsin Adm. Code Chs. SPS 320 to 325, inclusive, are hereby made a part of this chapter by reference. Despite the provisions of SPS 320.05(4), SPS 320 to 325 shall apply to all accessory buildings in the City." Ch. 14, § 14.03 (accessed June 23, 2014). The adoption does not clearly extend to all existing buildngs. The state code, however, is limited to new construction, additions and alterations for buildings constructed after 1980. In practice, the city might enforce the code as adopted to apply to work other than new construction, additions and alterations for buildings constructed after 1980; they ask for permits for work over $500. It applies to "code applies to all public buildings and places of employment" with certain exception. See Wis. Admin. Code § 361.02. The Code defines "public buildings" and "places of employment." The highest authority is reserved by the state. See Wis. Admin. Code § 361.03. However, local jurisdictions may adopt stricter standard that are not in conflict. Id. Furthermore, local jurisdiction, including counties, may take on inspection and review responsibilities. See Wis. Admin. Code § 361.60.
