A new era of Medicare compliance was ushered in with the Strengthening Medicare and Repaying the Taxpayer Act of 2012.
A PLRB webinar, "Medicare Reporting: Beyond SMART and the Upcoming Penalties," presented by Bennett Pugh, J.D., Franco Signor LLC, outlined the compliance provisions of the act.
The legislation was designed to provide relief for primary plans and responsible reporting entities, such as liability, no-fault, and workers compensation insurance carriers. It allows for conditional payment downloads from a web site. The act also provides for safe harbors for good faith reporting. Additionally, it softens the penalty for noncompliance.
The five key sections of the SMART act are reviewed in detail. Potential new regulations that will be imposed by the Centers for Medicare and Medicaid Services as the act is implemented are reviewed.
